4. (1) A Resident Commissioner may proprio mot‘u or on the
application of an ofiîoer of police or of the revenue or cf any other
oficinl of du Condominium Government issue a scarch warrant as
provided by Joint Regulation No. 2 oi‘ 1917 in respect of ships, boats,
stores, dwelling or other bouses and any building or plane in me
occupation of non-natives.
(2) Search warrants in respect of vessels belonging w or places
in the occupation of natives may be issned by the Public Prosecutor
eiflier on bis own initiative or on lb: application of une of the
oificials specifiod in the subsection next preoeding.
(3) Any pure alcohol or spirituous liquors found in the course
of execution of warrants issued under the provisions or this Regain-
tion shall be seized and confiscated and slmll be sold or otherwise
dispoaed of us the Joint Court may direct. If sold the proeeeds shall
be paid m the Condominium 'l‘reasnry to the aooount of the Con-
dominium Governmenl.
5. Branches cf the_ provisions of lhis Regulstion shall be
justiciable by the Joint Court and shall be punished by a fine of
from four to twenty pounds and with imprisonment for a term of
from one to thiny days or by on: or other cf those penalties. In tire
case cf a repen'tion of Ihe ofi'ence the maximinn penalty shnll be
inflimed. Provided Lhat should any person import spirituous liquors
of the category (2) in section 1 thereof wilhout having previously
obtained thc permission of a Resident Commissioner and such
liquors are plainly entend on the ship‘s manifest the Resident
Commissioners may conjointly order that proocedings under (bis
section of the Regulntions shall be dispensed with and thnt the goods
ahall be re-exportod.
6. The Commandants ofthe two Divisions of the Constabulary
and sunh oflim‘als as mnybe anthorisod by the Residem Commissioms
conjointly for the purpose shall report breaches of this Regnlation
whether committed by natives or non-natives to the Residencies on
whinh they may depend and the oflicial reports ofthe cases drawn up
by suc]: Commandants or other authorised oificials sball be prima
facie evidenoe before the competent authority of the facts contained
thervin.
7. Thi.‘ Regulan'on sludl be known as “The New Hebrides
Alcohol Importation Regnlntion No. 2 of 1972”.
