(d) If the square tequested encroaches on the area cf any licence
or lease valid for the saine minerais and which han been previouxly
applied for, the rights ol‘ the liccnsee shall be definitely limin t0 the
m'en avaflable at the time cf application.
(e) The application shall be registcred at the Department of
Mines, the date and heur cf its deposition being recorded in a special
register provided for the plu-pose. A receipt shall be issued.
(f) The prospecting licence shall be issued by flic Resident
Commissioners jointly in accordance with an crder cf priority
detel‘mined by the date and, if necessnry, the time cf filing of the
application and against payment cf a fee, calculated according to
the nrea applied for, which shxll be paid into Lhe joint budget.
(g) The Rcsident Commissioners nmy however:
(1) reject ail application for a prospecting licence or revoke a
licence already issncd, if it is established that Lhe application
for a licence bas been vitiated by serions irregularities which
cannot be corrected, in which case Lbe renson for tlu: deciaion
shall be communicated m the interested parties;
defer consideration cf an application for n licence withont
detrimcnt to its ordcr cf priority or suspend a licence alrendy
issued, ifit is established that prospecting in the area applied
l'or would be liable t0 disturb publie order.
(h) The prospecting licence shall be valid for two years frein the
date of issue; the Residcnt Commissioners mny renew il twice, for
two years each time ac the request cf the licensee.
Renewal shall be automatic unless the licensce bas given evidce
cf no activity cr [inadequate] activity only during the preceding
period cf validity. On the expiration cf tl-ie period of validity the
prospecting licence nhall be canœllcd and l'or the following four
months the licensee shall not be cligible [o obtain, cither directly cr
through an intermediary, the issue of a new licence in respect cf ail
or part cf the area concerned.
(i) The holder of a prospecting licence may be authorised by
joint dccision cf the Rcsident Commissioners 10 dispose of Lhe
minerais produced by his werk. Any prospecting whieh turns into
exploitation shall be prohibited by administrative direction.

7. (a) The holder cf a procpecting licence shall be entitled t0 a
mining 1eme if lie has during the period cf such licence fumished
prcof [to the satisfaction cf Lhe Rcsident Commissioncr] ai" Lhe exis-
tence of a minerai deposit within the area applied for.
(b) The mining lease shall confer on ils holder within the limits
of ils area and Wifliout limitation on vertical depth the exclusive
right cf prospecting for and working deposits cf the minerals for
which Lbe prospecting licence on which thc lease in based in valid and
in respect of which prool' cf the existence cf a deposit i5 fixrnished.
(c) The application for a lease must on penalty cf nullification:
l. reach the Departmenl cf Mines before tbe date cf expiration
